Singing up to ORIO CLOUD is assumed that user is well acknowledged about our Terms of Services. Use will also agree with our other terms as follows
By accepting these terms of services applicable for every ORIO CLOUD User, following standard policy is applicable for each ORIO CLOUD User We are against Spamming activities to maintain online reputation. If any user account or email address or any other services found involved in spamming activities, then for the first incident respective service will be suspended with first warning. If again such incidents will occur regularly then will be permanently terminated. No backup or data will be provided. If any service found involved in Adult, Abusive, Anti National, Anti Religious, hacking, bot site, scraping data, mirror site, Software Download, Video Download, Or any pirated script or online services, bank frauds, fake offers, anti social content, streaming videos., using CPU overlimit etc then your services will be terminated with or without any prior notice. Unlimited Hosting or any other unlimited plan does not mean that you can use service as your storage device. Our standard File upload permission is below 100 MB, if any user found above 100 MB limit then service / plan may be terminated with or without notice. In this case no backup or data will be provided. ORIO CLOUD has the right to change modify or discontinue any service / plan or pricing of any service/plan as per market analysis. In this case your plan will be upgraded to available topmost plan. No refunds will be provided in this case. We only process refunds as our commitment of 15 Days Money Back Guarantee. Only this clients eligible for refunds. No refunds will be processed for certain services like Domain Registration, VPS Server, Dedicated Server, SSL Certificates, Sitelock, etc. 15 Days Money Back Guarantee is valid for new customers from the date of order of only hosting services. If client is not satisfied with our hosting services can apply for refund. For processing refund it may take 45 days from application for refund. Lifetime Hosting Clients has 15 Days Money Back Guarantee. After that no refunds will be processed. Lifetime client has no yearly renewal for only hosting. Domain Registration, SSL Certificates and any other addon services will be charged as per plan.

Signing Up with ORIO CLOUD, User Accept Following Policies
You agree to use all ORIO CLOUD services and facilities at your own risk. ORIO CLOUD specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall ORIO CLOUD be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold ORIO CLOUD harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney s fees asserted against ORIO CLOUD, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it s agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless ORIO CLOUD against liabilities arising out of: Any injury, damage or loss to a person or property caused by any products sold or otherwise distributed in connection with ORIO CLOUD s server. ORIO CLOUD reserves the right to intervene with any of the sites hosted on its servers in the interest of its customers. Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement any defective products sold to customer from ORIO CLOUD s server. ORIO CLOUD shall be the sole judge of what violates this Policy.
Billing, Cancellation And Refund Policy
As a customer of ORIO CLOUD you agree to submit or supply a payment for the rendered services in advance, on the billing date set by ORIO CLOUD. By default these services will be billed on a recurring basis (if recurring payment option was chosen during registration or renewal of the appropriate hosting package, vps package or domain name package). You must notify ORIO CLOUD at least 7 days before the next automated renewal date if you wish to cancel the recurring payments without any further recurring charges ORIO CLOUD shall not be held responsible for recurring automated payment if notified less than 7 days before the next subscription payment date, and this payment will not be refunded).
Account Access Policy
When a client registers any type of account with ORIO CLOUD, the client will be held liable for the client identification information that is provided: a) Name and Surname of the Client b) Client Address c) Company details d) e-mail address. Should ORIO CLOUD suspect that any of the provided information is incorrect/fraudulent, the account may be suspended for terms of service violation until client contacts ORIO CLOUD and resolves the issue. ORIO CLOUD may use this information to contact the client if such need arises. Some of the information on the account will be generated automatically (username, password, payment IDs). Client may access the account at any time if he has access to the initial e-mail account that he used to register the account on ORIO CLOUD. If the client claims that he has no access to the respectable e-mail account and that he has no way to recover the password set on the account, he will need to provide us with the last payment date and payment IDs on which the payments were made, as well as full client name (name and surname), and full client address set on the respectable account. Client acknowledges and accepts this procedure and access policy and agrees not to bring any claim of a lawsuit against ORIO CLOUD arising out of this said policy and procedure. ORIO CLOUD will not be held liable for any damage or liability that may have arise out of following policy and procedure. In the event when there is more than one person claiming rights to the same account, who may or have provided the information which may provide them access to the respectable account following the ORIO CLOUD policy and procedures, then ORIO CLOUD is not obligated to provide access to any of the parties. Also, ORIO CLOUD is not obligated to solve any kind of such disputes and may solely decide who to provide access to according to internal information and historical data that may have been collected about the user, based on the usage on the respectable account.
If ORIO CLOUD found any such above mentioned activity with any client or user then ORIO CLOUD has the right to suspend or even terminate services with or without any notice. ORIO CLOUD will not be responsible for any Data or Financial loss in such a case.
ORIO CLOUD will not share any of its clients’ personal information to any third parties not related to ORIO CLOUD. Some of the client data may be forwarded on the following exceptions: Upon new domain registration via respectable Hosting domain registrar, Client Information will be sent to domain registry and may appear on WHOIS based sites unless the client chooses to turn on Domain Privacy from ORIO CLOUD Members Area. If domain privacy is turned on, then Client Information will not be displayed on WHOIS based sites, however it will still remain on the Domain Registry for security reasons. Please mind that domain privacy is not supported on .co.uk domain registrations. ORIO CLOUD will respond to court orders or other legal processes and may provide relevant information to relevant parties about the client on such a case, but will inform the end client about such process and will wait for a valid response from the end client before sending out the information to the respectable party. If the client who owns the related account fails to respond in 15 days we will send out the information to the respectable party without the confirmation of the client. Third Party Providers – some of the information will be sent to third-party providers such as Payment Gateways, Domain registrars, Additional Service providers (Plesk, Cloudflare, cPanel, Attracta, Trendybuilder). ORIO CLOUD will solely choose which third-party providers to send client information to. This depends on the services that will be offered by the third-party to ORIO CLOUD clients, however no client information will be sent to third-parties not related to ORIO CLOUD services. Certain services provided by ORIO CLOUD are resold. Thus, certain equipment, routing, software, and programming used by ORIO CLOUD are not directly owned or written by ORIO CLOUD. We will not be responsible for any changes in services provided by a 3rd party provider, also will not be held liable for any damage or loss which may arise from service disruption provided by a 3rd party provider. ORIO CLOUD will show highest interest to make sure that that services provided by a 3rd party are running smoothly and correctly, and will contact the 3rd party provider when changes or fixes are needed, however the time needed for any fix or alteration will not be decided by ORIO CLOUD and ORIO CLOUD will not be held liable for any fixes or alterations to be performed on a product provided by a 3rd party in a definite time frame.
Unlimited Disk Space Usage Policy
ORIO CLOUD offers some of its hosting packages with Unlimited amount of resources for specific options (disk drive space, bandwidth, domains per account, and others listed in the features page). This means that ORIO CLOUD will not set a specific cap for these resources and client will be able to use these resources as needed, however ORIO CLOUD does use a fair usage policy which applies to all accounts. ORIO CLOUD Fair Usage Policy implies that if the client uses the resources of the shared server to the extent where he is negatively affecting other users hosted on the same server, the resources may be capped or in some cases, but not necessarily, respectable account may be disabled before client upgrades his account to a package more suitable for his needs or fixes the issues so the resource usage on his account stops to negatively affect other users on the same shared server. By the term Unlimited Space ORIO CLOUD means that it will not set a cap on the amount of files the user may host on his account, however the space on the hosting account cannot be used for: Backup storage, Online storage, File sharing services, Movie storage, Photo storage, Software storage, Copyrighted content storage, Illegal, Abusive or Offending file storage, Document Archives or any other type of Archive, File Backups (with the exception of a single cPanel backup generated from your cPanel), log files, etc. ORIO CLOUD reserves the right to remove such files from the user account with or without notice to the client. ORIO CLOUD also reserves the right to remove any single files larger than 1GB from the user account regardless of the content of the file with or without notice to the client. ORIO CLOUD also reserves the right to clean up a user account by removing files which fall under the criteria of files that may not be hosted on ORIO CLOUD accounts, if there are more than 250000 files on a single Shared Hosting, Cloud Hosting, WordPress Hosting, Lifetime Hosting account, then it will be terminated with or without notice to the client. ORIO CLOUD also reserves the right to disable the account which holds more than 250000 files on Shared Hosting Account until the relevant shared hosting account is upgraded by the client to a vps service where such limitation is not applied. ORIO CLOUD reserves the right to clean up the disk of email accounts that exceed 20GB. Disk spaces (email accounts included) containing more than 30GB are subject to clean up. Resellers who are reselling ORIO CLOUD hosting can not exceed 250000 files limit or more than 20 GB Space for single web hosting account under their panel. If such activity is found then, we will terminate with or without any notice to reseller.
Limitations Of Liability
ORIO CLOUD shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from ORIO CLOUD servers going off-line or being unavailable for any reason whatsoever. Furthermore, ORIO CLOUD shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of ORIO CLOUD servers. All damages shall be limited to the immediate termination of service. Violations of these Acceptable Uses Policies should be referred to [email protected] All complaints will be investigated promptly.
ORIO CLOUD intends to provide the best possible web hosting service to each of its clients. ORIO CLOUD shows the most interest to use the latest technologies and solutions to make the service provided to the end client the best possible. However, ORIO CLOUD cannot be held liable for any system downtime, crashes, or data loss that may happen on the servers. Also, ORIO CLOUD will not be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. If any terms or conditions are failed to be followed, the account in question may be automatically deactivated by ORIO CLOUD. ORIO CLOUD retains the right to change, modify or delete any or all of the above Policies, Guidelines, and Disclaimer with or without prior notification.
